Terms of Service
1. Agreement
These terms are an agreement between you and Tomelet Pte Ltd ("Tomelet", "we") covering the Tomelet apps, the Tomelet Sync service and tomelet.app (together, the "Service"). By using the Service you accept them. If you do not agree, do not use the Service.
2. Licence
We grant you a personal, non-exclusive, non-transferable licence to install and use the Tomelet apps on devices you own or control, subject to these terms and the rules of the app store you obtained them from. Some components are open-source software under their own licences, listed in the app under Settings → About.
3. Your content
You own the books, files, annotations and notes you bring into Tomelet. You are responsible for having the right to use them. Tomelet does not remove or circumvent digital rights management (DRM); files protected by DRM other than Readium LCP may not open. Where Tomelet Sync is used, you grant us only the permission needed to store and transmit your encrypted data on your behalf. We cannot read it.
4. Accounts and security
You need an account only for Tomelet Sync. Keep your sign-in provider account and your Recovery Key secure. Because your synced data is encrypted with keys we do not hold, we cannot recover it if you lose all of your devices and your Recovery Key. You are responsible for keeping a backup (Settings → Backup).
5. Tomelet Sync subscription
- Tomelet Sync is a recurring subscription, currently US$9.99 per month (local prices may differ), with a 14-day free trial for new subscribers. Prices and plans may change; we will give notice before a change affects you.
- Subscriptions bought through Google Play or the Apple App Store are billed, renewed and cancelled through that store and subject to its terms and refund policy. Tomelet does not currently offer subscriptions through web checkout.
- Subscriptions renew automatically until cancelled. Cancel at least 24 hours before the end of the current period to avoid being charged for the next one.
- Storage is limited to 10 GB of encrypted files per account. We may adjust limits with notice.
- If a subscription lapses, sync stops but your local data stays on your devices; encrypted server data is retained for 90 days and then deleted.
6. Advertising
The free app is supported by advertising served by Google AdMob, shown before a book opens. Tomelet Sync subscribers see no advertising.
7. Acceptable use
Do not use the Service to break the law, to infringe others' rights, to attack, overload or reverse-engineer the Service (except where the law permits), to resell it, or to store material that is illegal in your jurisdiction. We may suspend accounts that abuse the Service.
8. Availability and changes
We aim for high availability of Tomelet Sync but do not guarantee it. We may change, suspend or discontinue features with reasonable notice; if we discontinue Tomelet Sync we will give at least 90 days' notice so you can export your data.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. Nothing in these terms limits rights you have as a consumer that cannot be excluded by law.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for loss of data that results from lost devices or a lost Recovery Key, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
11. Termination
You can stop using the Service and delete your account at any time (see Delete account). We may terminate accounts that breach these terms.
12. Governing law
These terms are governed by the laws of Singapore, and disputes are subject to the courts of Singapore, without affecting mandatory consumer protections where you live.
